We value your privacy. Our privacy policy sets out how we process and protect your personal data.

1. INTRODUCTION

1.1 LightHub (“LightHub/we/our/us“) operate lighthub.law plus associated products and services (collectively the “Site“) for the benefit of its users and clients (“you/your“). We have appointed an internal data protection officer to contact if you have any questions or concerns about our data policies or practices. 1.2 We respect your privacy and are committed to protecting it.

1.3 This Policy explains how we collect and use information about individuals (“Data Subjects“), including any information which identifies you, including your name, address, contact numbers, email addresses, user names, and account numbers (“Personal Information“).

1.4 We recognise that information privacy is an ongoing responsibility and will, from time to time, update this Privacy Policy or adopt new privacy policies as necessary.

1.5 We do not knowingly attempt to solicit or receive information from children.

2. CONSENT

2.1 By using the Site, you explicitly and unambiguously consent to the collection, use and transfer of your Personal Information in electronic or other forms.

2.2 You understand that LightHub, the Site and its vendors (click here for a list of LightHub’s vendors) may hold certain Personal Information about you, which may include:
2.2.1 name;
2.2.2 surname;
2.2.3 email address;
2.2.4 residential and postal address;
2.2.5 date of birth;
2.2.6 contact numbers;
2.2.7 financial information and
2.2.8 Internet Protocol (IP) address.

2.3 You further understand that LightHub and its vendors will transfer data among themselves for implementation, administration and management of participation on the Site and with our business when offering you services or products.

2.4 You authorise us to receive, possess, use, retain and transfer such data as may be required for the Site’s administration and offering of the Site to you.

2.6 Where we have collected Personal Information on the lawful basis of consent, you may have the right to withdraw this consent. However, this will not affect the lawfulness of collection and use based on consent before its withdrawal.

3. USER PERSONAL INFORMATION AND USE OF PERSONAL INFORMATION

3.1 We may collect personal information about you. We use this information to provide access to the Site. We do not sell Personal Information to anyone and only share it with authorised third parties (see the list of LightHub vendors).

3.2 The Site collects certain information automatically and stores it in log files. The information may include internet protocol (IP) addresses, the region or general location where your computer or device is accessing the internet, browser type, operating system and other usage information about the use of LightHub’s website, including a history of the pages you view. We use this information to help us improve the design and functionality of our Site. We may also use your IP address to help diagnose problems with our server and administer our Site, analyse trends, track visitor movements, and gather broad demographic information that assists us in identifying visitor preferences.

3.3 We may use your Personal Information to confirm to validate you when using our Site; to prevent and detect criminal activity, fraud and misuse of or damage; to prosecute those responsible and to offer our services to you, and:
3.3.1 to contact you regarding current or new products or services or any other offering by us or any of our divisions, affiliates and/or partners (unless you have opted out from receiving marketing material from us);
3.3.2 to inform you of new features, special offers and promotional competitions offered by us or any of our divisions, affiliates and/or partners (unless you have opted out from receiving marketing material from us); and
3.3.3 to improve our product selection and your experience on our website by, for example, monitoring your browsing habits.

4. SENSITIVE PERSONAL INFORMATION

4.1 Other than in the circumstances allowed or required by applicable law, such data will only be collected with the consent of the Data Subject.

5. COOKIES

5.1 This website uses “cookies” to automatically collect information and data through the standard operation of the Internet servers. “Cookies” are small text files a website can use (and which we may use) to recognise repeat users, facilitate the user’s ongoing access to and use of a website and allow a website to track usage behaviour and compile aggregate data that will enable the website operator to improve the functionality of the website and its content, and to display more focused advertising to a User by way of third-party tools. The type of information collected by cookies is not used to identify you personally. If you do not want information collected through cookies, there is a simple procedure in most browsers that allow you to deny or accept the cookie feature. Please note that cookies may be necessary to provide you with certain features available on our website. 6. LINK TO THIRD PARTY WEBSITES

6.1 The Site may include links to other websites. These websites are governed by their own privacy policies. Once you leave our Site, the use of information you provide is governed by the privacy policy of the site you are visiting. That privacy policy may differ from ours. It is your responsibility to understand the privacy policies of such websites.

7. INFORMATION SHARING

7.1 We will not disclose your Personal Information to any party other than as set out below:
7.1.1 to our employees and/or third parties who assist us to interact with you via our Site or business, email or any other method, or to assist us in communicating with you properly and efficiently;
7.1.2 to our divisions, vendors, affiliates and/or partners (including their employees and/or third party companies) for them to interact directly with you via email or any other method for purposes of sending you marketing material regarding any current or new products or services, new features, special offers or promotional items offered by them (unless you have opted out from receiving marketing material from us);
7.1.3 to relevant authorities, government officials, fraud detection agencies or other third parties when we believe in good faith that the disclosure of Personal Information is necessary to prevent physical harm or financial loss, to report or support the investigation into suspected illegal activity, or to investigate violations of use;
7.1.4 to our service providers (under contract with us) who help with parts of our business operations (fraud prevention, marketing, technology services etc.);

7.2 We may be obliged to disclose your Personal Information to the extent that it is required to do so by law, in respect of any legal proceedings or other such occurrences.

8. DATA SUBJECT RIGHTS

8.1 We recognize that countries’ applicable privacy laws may provide several privacy rights for Data Subjects. We respect and are committed to complying with these rights. We will, within reason, assist Data Subjects in exercising these rights in relation to LightHub.

8.2 We will, within reason and the scope of applicable legislation, provide you with access to your Personal Information and provide mechanisms for you to exercise your rights as a Data Subject.

8.3 Receipt of a request from a Data Subject to exercise an applicable right will be actioned as soon as reasonably practicable. A response is provided to a Data Subject without undue delay and in a form that is accessible to the Data Subject.

8.4 We will be entitled to refuse to disclose any request where an exemption in law applies.

9. INFORMATION SECURITY

9.1 If we become aware of any unauthorised use, disclosure or processing of your Personal Information, we will notify you promptly following applicable law.

9.2 We will do all things reasonably necessary to protect your privacy rights. Still, we cannot guarantee or accept any liability whatsoever for unauthorised or unlawful disclosures of your Personal Information, whilst in our possession, made by third parties who are not subject to our control unless such disclosure is a result of our gross negligence.

9.3 If you disclose your Personal Information to a third party, such as an entity which operates a website linked to this Site or anyone other than us, we shall not be liable for any loss or damage, howsoever arising, suffered by you as a result of the disclosure of such information to the third party. This is because we do not regulate or control how that third party uses your Personal Information. You should always ensure that you read the privacy policy of any third party.

9.4 To help protect the privacy of data and Personal Information you transmit through the use of the Site, we maintain physical, technical and administrative safeguards. We update and test our security technology on an ongoing basis. We restrict access to your data to those who need to know that data to provide products, services and Site access to you. In addition, we train our employees about the importance of confidentiality and maintaining the privacy and security of your data.

9.5 All information obtained by us is stored on secure servers. Notwithstanding this, no security measures or systems are impenetrable. We cannot make any guarantees against data breaches.

10. DATA RETENTION

10.1 We retain data for the duration of the business relationship with us and for a period of time thereafter to allow you to recover accounts if you decide to renew, to analyse the data for our operations, and for associated historical and archiving purposes.

10.2 We will not retain your Personal Information longer than the period for which it is needed unless we are required by law to do so, or you consent to us retaining such information for a longer period.

10.3 We may also retain your Personal Information to the extent and duration that we have a legitimate interest to do so depending on, amongst others, the nature and lifespan of the products or services obtained from us.

10.4 We will upon your request, promptly return, destroy or anonymise/de-identify any of your Personal Information in our possession or control as soon as reasonably practicable after we are no longer authorised to retain the record, save for that which we are legally obliged to retain.

11. REPORTING OF RISKS RELATED TO PERSONAL INFORMATION

11.1 If a person suspects or becomes aware of –
11.1.1 any use of Personal Information in breach of this Privacy Policy;
11.1.2 a potential risk to LightHub privacy practices;
11.1.3 any breach of privacy or data security laws that regulate the business of LightHub,
11.1.4 such person must report this to us without delay.

11.2 Reporting risks in terms of 11.1 is treated as confidential, and the identity of reporting individuals will be treated as such (except where legal proceedings require otherwise).

11.3 If any person suspects, identifies or is involved (whether knowingly or unintentionally) in a breach or incident that may involve or lead to unauthorised access to/or use of Personal Information, such person must report the incident as a matter of urgency to us.

12. CROSS-BORDER TRANSFERS OF PERSONAL INFORMATION

12.1 We will only transfer Personal Information to foreign countries in compliance with the terms of applicable privacy law and good industry practice. Certain data (including Personal Information) may be transferred to parties in other jurisdictions.

13. TRANSFERRING PERSONAL DATA TO THE U.S.

13.1 LightHub has its head office in the United States. Information we collect about you will be processed in the United States. By using our Site and services, you acknowledge that your Personal Information will be processed in the United States. The United States has not sought nor received a finding of “adequacy” from the European Union under Article 45 of the GDPR. Under Article 46 of the GDPR, we provide appropriate safeguards by entering binding, standard data protection clauses, enforceable by data subjects in the European Economic Area and the United Kingdom.

13.2 Depending on the circumstance, we also collect and transfer to the U.S. Personal Information with consent or to perform a contract with you. We endeavour to apply suitable safeguards to protect the privacy and security of your Personal Information and to use it only consistent with your relationship with us and the practices described in this Privacy Policy. We also enter into data processing agreements and model clauses with third parties whenever feasible and appropriate.

14. MARKETING

14.1 We will only send you direct marketing when you have either provided consent or where we believe we can demonstrate a legitimate interest and have balanced this with your interests and privacy. You have the right to opt out of receiving direct marketing at any time by following the appropriate channels.
